President Trump's First Speech to Congress

The town hall hosted by Fox News' Martha MacCallum touched on illegal immigration and President Trump's temporary travel ban. Opponents argued it was overreach. The draft includes language meant to protect transgender students against bullying, which DeVos asked be included, a source said.

The letter cites the role of states in saying, "the Departments believe that in this context, there must be due regard for the primary role of the States and local school districts in establishing educational policy". Those memos stated that not allowing students to use the facilities corresponding with their gender identity was a violation of Title IX, which bars discrimination based on sex. "The Oregon guidance is still in place, and there are protections for transgender students out there".

The Obama administration last May told public schools to grant bathroom access even if a student's chosen gender identity isn't the same as what's in their record. The message, which is reportedly set to be sent out on February 22, will take away bathroom rights for students who identify as transgender. Supreme Court Wednesday that it had instructed American schools to disregard Obama administration efforts regarding transgender students.

The letter, according to the Post, mentioned that schools must protect all students and that the withdrawal of the guidance "does not diminish the protections from bullying and harassment".

"Since that time, the Department has not enforced that part of the guidance, thus there is no immediate impact to students by rescinding this guidance".

"We have a responsibility to protect every student in America and ensure that they have the freedom to learn and thrive in a safe and trusted environment", Education Secretary Betsy DeVos said in a statement. Trump, however, says that states and public schools should have the authority to make their own decisions on matters such as this.

At issue is the "Emoluments Clause", a previously little-known constitutional provision that says that USA presidents may not accept gifts or make a profit from any foreign state. That's also how the Obama guidance viewed gender identity for students who are too young for reassignment surgery.
