Federal complaint on Tad Cummins' alleged sex crimes — GRAPHIC

A family lawyer tells ABC News they were found at a commune.

The Siskiyou County Sheriff's Office got the tip last night at 9:00 p.m.when a Cecilville man told them that he saw a vehicle matching that of Tad Cummins' in the area. Cummins was taken into custody. Thomas was safely recovered.

As of 6 p.m. Thursday, Cummins remained in the custody of the Siskiyou County jail where he's being held without bond, awaiting extradition to Tennessee.

The 49-year-old woman who was married to her husband for 31 years is seeking alimony and attorney fees, according to the four-page suit. "We had everything we ever wanted". "I feel so hurt I can't even function".

"I was driving by trying to flush him out". But I don't trust him anymore.

Brett Cooper, district attorney of Maury County, said Thomas' family is home in Columbia waiting for her to return.

Thomas, 15, was the subject of a Tennessee AMBER Alert issued on March 14, after having been kidnapped a day earlier by Cummins, a former teacher at Culleoka Unit School in southeast Maury County. They were last spotted by a Walmart surveillance camera in Oklahoma City on March 15, two days after they disappeared from Columbia, Tenn., almost 700 miles away. The pair spent one night in the cabin before the arrest, but they may have been in the area for about a week, Gilley said.

Thomas, who police believe left willingly with her captor, had a troubled past, WSMV reported.

"Subsequent investigation revealed that Cummins had no scheduled interview", the complaint said. She and her husband even took the teen to church.

The complaint alleges Cummins left a note for his wife on March 13 saying he was leaving for a while to "clear his head".

Thomas and Cummins had been missing for two weeks.

TBI Director Mark Gwyn said he's "facing a set of charges that should be keeping him behind bars for many years".

She said she's proud of her community, and is confident local officials will find a way to learn from this entire ordeal. Cummins: "Of course I love him. I was like, whatever, they're on hard times or something".

April 3 - TBI confirmed photos from Nebraska police were not Cummins and Thomas. Family members said he needs to refill blood pressure medication. A short time later, investigators say, he drove to a Shoney's restaurant, where Elizabeth had been dropped off by a friend and was waiting.

Cummins was sacked from his teaching job after being accused of having an inappropriate relationship with Thomas.

According to law enforcement in Tennessee, another student reported Cummins to school administrators in January.

"The area is so remote, a lot of people come out there to hide it's like a one-horse wilderness town". Cummins was also terminated from MCPS.

"Someone was showing me a picture, I was telling them, you know, and said 'That's the guy, '" Barry told KOBI. What we're anxious about is Elizabeth and her safety.

"I believe the Federal Bureau of Investigation are going to make sure she's healthy before she comes home", she added.

Missing Columbia teen Elizabeth Thomas was found in Northern California with her alleged kidnapper, 50-year-old Tad Cummins.
