Justice Karnan's lawyers approach president for suspension of SC order

Nethumpara, who claims to be the lawyer for Kolkata High Court sitting Judge Justice C. S Karnan, approached President Pranab Mukherjee and filed a petition on Friday, seeking suspension of the Supreme Court order sentencing Karnan to six months imprisonment for contempt of court.

Justice Karnan was sentenced to undergo imprisonment for six months after being held guilty for contempt.

Nethumpara pleaded to exercise the jurisdiction invested in his Excellency under Article 72 of the Constitution and suspend or stay the operation of the order dated May 9, passed by the Supreme Court convicting and sentencing the petitioner Justice Karnan. Counsel said "Justice Karnan has been sent to jail without even giving him an opportunity and without the sanctity of Parliament which alone can remove him". "I thus see no reasonable cause to receive the present writ petition for registration under the provisions of Supreme Court rules, 2013", the registrar said. He had made a decision to seek a review in the Supreme Court seeking a recall of the order.

With this order being passed, the police can now go ahead and arrest Karnan.

High Court judges get paid out of the Consolidated Fund of India. If the said allegations are untrue, they would at the most amount to defamation which will entail an actionable right, both civil and criminal, in the Judges named in the said letter.

Meanwhile, the lawyers representing Justice Karnan have claimed that a representation has been made to the President seeking suspension of the Supreme Court order sentencing him to six-month imprisonment for contempt.

However, the President's office has said, "It was not aware of any such representation".
