SC extends deadline for Aadhaar linkage up to March 31, 2018

The Centre had fixed the deadline to link Aadhaar with bank accounts to December 31, this year.

A five-judge Constitution Bench headed by Chief Justice Dipak Misra, in an interim order, also modified its earlier order with regard to linking of Aadhaar with mobile services and said the deadline of February 6 next year for this goal also stood extended till March 31.

The government has extended the deadline to link Aadhaar with bank accounts from December 31, 2017 to March 31, 2018.

The SC's observation in the favour of the Department of Revenue in the Ministry of Finance comes three days after the government said that the deadline to link the 12-digit Aadhaar card number to any account related proceedings is March 31.

The government on Wednesday issued a notification to extend till March 31 the deadline for mandatory quoting of Aadhaar and Permanent Account Number (PAN) for bank accounts and certain financial transactions.

The Finance Ministry statement had stated, "After considering various representations received and inputs received from banks, it has been made a decision to notify 31st March, 2018 or six months from the date of commencement of account based relationship by the client, whichever is later, as the date of submission of the Aadhaar number, and Permanent Account Number or Form 60 by the clients to the reporting entity". In the meanwhile, the application number of Aadhaar can be submitted to the bank. The Bench had subsequently asked the counsel for the petitioner to approach the Constitution Bench with their issues. The bench said it would pass appropriate orders on Friday.

The court had earlier tagged 22 cases to be heard by a smaller bench.

The cases challenge several aspects of Aadhaar, including the use of data collected under the unique identification programme.

Two new pleas challenging Aadhaar-one by the West Bengal government on the mandatory linking of Aadhaar to various schemes and another challenging its mandatory linking with mobile numbers-have also been brought to court.

The apex court said the Constitution Bench would commence final hearing from January 17 on the petition challenging the Aadhaar scheme itself.
